General Terms and Conditions B&Eau Water Parks and Swimming Pools

1. Definitions
In these terms and conditions, the following is understood:

• Contractor: B&Eau
• Client: The natural or legal person who issues the assignment.
• Agreement: The agreement between Client and Contractor.

2. Applicability
These terms and conditions apply to all quotes, services, and agreements of B&Eau regarding swimming pool and water park design and advice in these areas.

3. Quotes and agreements
Quotes are non-binding and valid for 30 days (unless otherwise stated). An agreement is established after written confirmation by the Client.

4. Execution of the assignment
B&Eau will execute the assignment to the best of its knowledge and ability, taking into account the requirements of craftsmanship.

5. Prices and payments
All prices are inclusive of VAT and other charges. B&Eau participates in the small business scheme (KOR). The amounts on the invoice are final prices.
Payment must be made no later than 14 days after the invoice date.

6. Liability
B&Eau is not liable for indirect damage, such as consequential damage, lost profit, or missed savings.

7. Force majeure
In case of force majeure, which is understood to mean any circumstance independent of the will of the parties, the execution of the agreement is suspended.

8. Intellectual property rights
All designs and advice developed by B&Eau are and remain the property of B&Eau, unless otherwise agreed in writing.

9. Applicable law and disputes
Dutch law exclusively applies to all legal relationships in which B&Eau is a party. Disputes are submitted to the competent court in the district where B&Eau is located.
